1. Introduction

Welcome to Jitva Foundation. We are a non-profit organization that provides free medical camps, health awareness programs, emergency assistance and other community services. These Terms describe the rules and responsibilities for all users of our website and services, including donors, volunteers, beneficiaries, vendors, and partners.

By using our website, registering on the platform, making donations, volunteering or otherwise engaging with our programs you accept and agree to abide by these Terms. If you do not agree, please do not use our services.

2. Acceptance of Terms

By accessing or using the site and services you confirm that you are at least 18 years old (or have the consent of a parent/guardian where applicable), that you have the legal capacity to form a binding contract, and that you accept these Terms together with our Privacy Policy and other policies posted on the site.

3. Eligibility

Use of the website is restricted to individuals and entities who can form legally binding contracts under applicable law. Prohibited users include those barred from receiving services, persons under sanction, or anyone whose participation would violate local or international law.

4. Accounts, Registration & Security

When you create an account, you agree to provide accurate, current and complete information and keep it updated. You are responsible for maintaining the security of your account credentials and must notify us immediately of any unauthorized access or suspicious activity.

You accept responsibility for all activities that occur under your account. We reserve the right to suspend or terminate accounts for suspicious, fraudulent or illegal activity.

5. Services Offered

Jitva Foundation operates multiple community and health-related programs, including but not limited to:

• Free medical camps and screening programs
• Emergency assistance and referral support
• Health awareness and education
• Volunteer training and coordination
• Fundraising and donation management

Program details, eligibility criteria, schedules and availability may change. We will endeavor to notify registered participants of major changes but do not guarantee advance notice for all changes.

6. Donation Terms

Donations are voluntary contributions to support our mission. By donating you acknowledge and agree to the following:

1. Donations made via the website, UPI, bank transfer or other channels are final, unless a specific refund right is provided under our Refund & Cancellation Policy. Donations may be tax-deductible where permitted by law; donors should consult their tax advisor for details.
2. We will use donated funds in accordance with our stated objectives and accounting practices. Donors do not receive any ownership, interest or control over the funds once donated.
3. Donations may be designated to specific campaigns; however, if a campaign is overfunded, cancelled or cannot be executed, we may reallocate funds to substantially similar programs consistent with donor intent and applicable law.
4. Donation receipts will be provided as per our procedures. Provide accurate contact and email information to ensure receipt delivery.
5. We reserve the right to decline, refund or reallocate donations that appear to be the result of fraud, error, or illegal activity.

For recurring donations, donors may cancel recurring payments directly through the payment method they used or by contacting us. Cancellation requests must be received before the next scheduled charge to prevent future debits.

7. Refund & Cancellation Policy (General)

Our refund and cancellation rules vary by transaction type:

• Donations: Donations are generally non-refundable unless made in error, or required by law, or where we choose to provide a refund at our discretion. For payment errors or duplicate donations, contact us promptly.
• Event Registrations / Paid Programs: Refund eligibility for paid events, training or services will be stated in the event terms. Where not specified, cancellations more than 15 days prior to the event may be eligible for a refund less administrative fees; cancellations within 15 days may be non-refundable.
• Merchandise / Purchases: If applicable, return and refund policies for merchandise are provided on the product page and on the invoice.

To request a refund or cancellation, please contact Jitva Foundation at support@jitva.help with transaction details, proof of payment and a reason for the request. We will investigate and respond within a reasonable period.

8. Privacy & Data Usage

Our Privacy Policy governs the collection and processing of personal data. Personal data may be used for:

• Processing donations and issuing receipts
• Volunteer coordination and program delivery
• Administrative, reporting and legal compliance
• Communications regarding our services, events and fundraising

9. Third-Party Services & Links

The site may link to external sites and use third-party payment processors, analytics providers and service platforms. We are not responsible for third-party websites' content, practices or privacy policies. Use of third-party services is at your own risk and subject to their terms.

10. Limitation of Liability

To the fullest extent permitted by law, Jitva Foundation and its partners, officers, volunteers and employees will not be liable for any indirect, incidental, consequential, special or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the site or services.

Our aggregate liability for any claim arising out of or relating to the site or services is limited to the amount you paid for the service (if any) that gives rise to the claim during the 12 months preceding the claim.

11. Intellectual Property

All content on the website, including text, images, logos, graphics, code and software, is owned by or licensed to Jitva Foundation and is protected by copyright, trademark and other laws. You may view and print content for your own non-commercial use only. Reproduction, modification, distribution or any commercial use without written permission is strictly prohibited.

12. User Generated Content

If you submit content (reviews, comments, images), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, adapt, publish and display such content across media. You represent and warrant that you own or have the necessary rights to submit the content and that it does not violate any third-party rights.

13. Security & Fraud Prevention

We implement reasonable technical and organizational measures to protect systems and data. We monitor transactions and may suspend or refuse service for suspicious or fraudulent activity. You must not attempt to interfere with site security or perform actions that threaten other users' data or access.

14. Governing Law

These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Pune, unless otherwise agreed in writing.

15. Dispute Resolution

We encourage you to contact us to resolve disputes informally. If a dispute cannot be resolved informally within a reasonable period, the parties may pursue arbitration or litigation subject to this Agreement and applicable law.

16. Termination & Suspension

We may suspend or terminate your access for any reason, including breach of these Terms, illegal conduct, or at our discretion. Termination does not relieve you of obligations that accrued prior to termination.

17. Changes to these Terms

We may update these Terms occasionally. Notice of material changes will be provided via the website or email to registered users. Continued use after notice constitutes acceptance of the updated Terms.

18. Miscellaneous

Severability: If any provision is invalid, the remainder remains effective. Waiver: Failure to enforce a right is not waiver of that right. Entire Agreement: These Terms and referenced policies form the entire agreement between you and Jitva Foundation.
